He returned to Salt Lake and enrolled in the Utah University graduate school, where he received a master's degree in Psychology in 1977. Joe Tesch, who worked for Attorney General Paul Van Dam, asked Jan to apply for a lawyer job in 1990. He ran for office as Attorney General in 1992, when he was pregnant with his first child. She gave birth to her baby two days after the State Democracy Convention. In the election, he defeated the Iron Lawyer, Scott Burns, getting 49% of the vote across the state. He was re-elected in 1996 in a rematch with Burns with 52% of the vote.

Jan Graham makes Utah state plaintiff in prominent tobacco law. Litigation includes arguments over the Attorney General's powers, both from tobacco companies, and from Utah Gov. Michael Leavitt. The struggle between the only holder of office across Democratic states in Utah and the Republican legislature as well as the Governorate of the state resulted in the issuance of a law that obliged the Governor to be fine in civil litigation. The Attorney General sued, a compromise was reached, and the law was eventually lifted.

At the end of his second term, Jan Graham was one of two women on Deseret News's list of the most powerful men in Utah. In addition to being the only woman ever elected in a state office in Utah, he is also the last Democrat to be elected in a state office in Utah.
