The United States District Court for the Southern District of New York (in the case excerpt, S.D.N.Y. ) is a federal district court. An appeal from the Southern District of New York was brought to the US Court of Appeals for the Second Circuit (except for patent claims and claims against the US government under the Tucker Act, which appealed to the Federal Circuit).

The Southern District is one of the most influential and active federal district courts in the United States, mainly because of its jurisdiction over New York's main financial center.

Jurisdiction

Court jurisdiction consists of the following countries: New York (Manhattan), Bronx, Westchester, Putnam, Rockland, Orange, Dutchess, and Sullivan. The United States Attorney's Office for the Southern District of New York represents the United States in criminal and civil litigation in court. The current United States Interim Attorney is Geoffrey Berman since January 5, 2018. The trial is housed in the Thurgood Marshall Courthouse of the United States and Daniel Patrick Moynihan of the United States Courthouse, both in Manhattan, and in the Federal Building of Charles L. Brieant and Courthouse in White Plains.

History

The United States District Court for the District of New York is one of 13 courts established by the Justice Act of 1789, 1 Stat. 73, on September 24, 1789. First sat on the old Merchants Exchange on Broad Street in November 1789, the first federal court to do so. The Act of April 9, 1814, 3 Stat. 120, divides the New York District to the North and South Districts. District divisions were reportedly raised by Matthias Burnett Tallmadge, due to antipathy towards fellow district judge William P. Van Ness. These districts were subdivided with the establishment of the Eastern District on 25 February 1865 by 13 Stat. 438, and the Western District on May 12, 1900, with 31 Stat. 175.

During the first hundred years of its existence, District case loads were first dominated by admiralty cases, and then by a mixture of admiralty and bankruptcy cases. The primary responsibility for hearing the bankruptcy case has been transferred to the United States Bankruptcy Court for the Southern District of New York, with the District Court only reviewing cases that have been decided by a bankruptcy judge.

Since its establishment, the Southern District of New York has 149 judges, more than any other District. Nineteen judges from the Southern District of New York have been appointed to the US Court of Appeals for the Second Circuit - Samuel Blatchford, Charles Merrill Hough, Learning Hand, Julius Marshuetz Mayer, Augustus Noble Hand, Martin Thomas Manton, Robert P. Patterson, Harold Medina, Irving Kaufman, Wilfred Feinberg, Walter R. Mansfield, Murray Gurfein, Lawrence W. Pierce, Pierre N. Leval, John M. Walker Jr., Sonia Sotomayor, Denny Chin, Barrington Daniels Parker Jr., and Gerard E. Lynch. Two judges, Samuel Blatchford and Sonia Sotomayor, were appointed from the Southern District of New York to serve as Circuit Judges for the Second Circuit and then appointed to the United States Supreme Court. The longest serving judge, David Norton Edelstein, served as an active judge for 43 years to this day, and in senior status for an additional six years.

The Court Judge has gone to another high-ranking government position. Robert P. Patterson Sr. acting as Deputy Secretary of War under President Franklin Roosevelt and Secretary of War under President Harry S. Truman. Louis Freeh served as Director of the Federal Bureau of Investigation from September 1993 to June 2001. Michael Mukasey serves the 81rd US Attorney General under President George W. Bush.

Famous cases

Injuries and loss of life claimed from the sinking of the Titanic, torpedo attacks on Lusitania and the fire on the ship General Slocum was heard at SDNY The espionage court of Julius and Ethel Rosenberg and the trial of false oath from Alger Hiss was also heard in SDNY

Judge John M. Woolsey from S.D.N.Y. rejecting government efforts to censor on the basis of obscenity distribution from James Joyce Ulysses . Judge Murray Gurfein of the Court rejected the government's attempts to order the New York Times to publish the Pentagon Papers. Allegations of slander are heard in S.D.N.Y. against CBS and Time magazine by General William Westmoreland and Israeli General Ariel Sharon.

Two former US Attorney General indicted and tried in S.D.N.Y. for crimes while in office - Harry Daugherty from the Teapot Dome era and John Mitchell from the Watergate era. The jury can not reach a verdict in two trials against Daugherty and John Mitchell is released.

Financial fraud has been charged in S.D.N.Y., among them cases against Bernard Madoff, Ivan Boesky and Michael Milken.

The trial of those accused of bombing the US embassy in 1998 in East Africa, those accused of being responsible for the 1993 World Trade Center bombing and Omar Abdel Rahman, known in the press as "The Blind Sheikh," occurred in the District. Recently, the prosecution arising from the 2010 Times Square car bombing effort and the prosecution of Abduwali Muse, called Somali Pirate, was heard in Court.

Criminal cases against Bess Myerson, Leona Helmsley and Martha Stewart were heard in S.D.N.Y., as did the US case against Imelda Marcos.

District Judge

The US District Court for the Southern District of New York has 28 official jurisdictions, filled by a judge appointed by the President and confirmed by the Senate. Eighteen judges who have taken senior status are entitled to continue the hearing cases. On June 1, 2016, the District Chief Judge was Judge Colleen McMahon, succeeding Judge Loretta Preska, whose seven-year term as Chief Justice ended. Senior Judge Charles S. Chief Justice

The Chief Judge has administrative responsibility for their district court. Unlike the Supreme Court, in which one justice is specifically nominated for head, the office of the chief judge revolves among district court judges. To be a chief, a judge must have been active in court for at least a year, under 65, and has never served as a chief judge. Vacancies are filled by the highest judges in seniority among eligible judges. The presiding judge shall be valid for a period of seven years or until the age of 70, whichever occurs first. Age restrictions are waived if no court member will qualify for that position.

When the office was founded in 1948, the chief judge was the longest serving judge who did not choose to retire on what has been known since 1958 as a senior status or refused to serve as a chief judge. After 6 August 1959, the judge could not become or remain head after the age of 70 years. Current rules have been in operation since October 1, 1982.
