Mark Rankin Herring (born September 25, 1961) is an American lawyer and Attorney General of Virginia who is 47th and current. He is a member of the Democratic Party. Previously, he served in the Virginia Senate since a special election in 2006. He represents the 33rd district, comprised parts of the Fairfax and Loudoun areas.

Early life and education

Herring was raised by a single mother in Loudoun County, Virginia. He works in construction and many other jobs to pay for tuition. He eventually earned a Bachelor of Arts degree, majoring in foreign and economics at the University of Virginia. He also holds a Master of Arts degree in foreign field from UVA. He then obtained a J.D. from the University of Richmond School of Law.

Careers

He served at the selected office of the Loudoun County Supervisory Board from 2000 to 2003, and became City Attorney for Lovettsville, Virginia, from 1992 to 1999. He was principal of The Herring Law Firm, P.C., in Leesburg, Virginia.

Herring was elected a member of the Virginia Senate in a special election sparked by two President Bill Mims' appointments as Virginia deputy attorney general's chief. He was re-elected for a full term in 2007 elections, and was re-elected in 2011.

On July 24, 2012, he announced that he would run for the post of Attorney General of Virginia, in the 2013 election. On April 2, 2013, the Virginia Democratic Party (DPVA) declared that Herring's name would appear at the main vote in June. On June 11, 2013, Herring won the first.

Democrats Jennifer Wexton won the election to replace him in representing the 33rd Senator District.

2013 election

Herring faces Justin Fairfax in primary Democrats in June 2013, winning thin with a 52% -48% margin. He faces Republican Mark Obenshain in the general election.

On election night, Obenshain leads 1,200 votes above Herring. The total vote fluctuates when the ballots are serviced on the following days, and the race stays too close to reach. On November 12, 2013, with all ballots counted, Herring led 165 votes, or less than 0.01%, and Obenshain asked for a recount. Total Herring increased during recount, so Obenshain admitted the election on December 18, 2013, and then that day, the recount ended with Herring winning with 907 votes, or 0.04%.

Virginia Marriage Amendment

On January 23, 2014, Herring announced that he would not defend the Virginia Marriage Amendment in federal court, and filed a complaint in a federal suit filed against the law requesting that the charges be beaten. Herring said in a press conference announcing the move, "I believe the freedom to marry is a fundamental right and I intend to ensure that Virginia is on the right side of history and the right side of the law."

The reaction to the announcement was mainly along party lines, with the Democrats mostly praising the move and Republicans mostly criticizing it as a violation of the oath of office. The National Organization for Marriage called for the impeachment of Herring, claiming that Virginia's attorney general was obliged to defend all state laws against the challenge. At a press conference, Herring said, "There are people who will say that prosecutors are needed to defend every challenge to state law, even unconstitutional laws.

The amendment will be unconstitutionalized by the US District Court in Norfolk in the case of Bostic v. Schaefer on February 13, 2014. On July 28, 2014, the Court of Appeal of the Fourth Circuit issued 2-1 opinions in favor of a lower court decision. This was filed with the United States Supreme Court, which rejected certiorari certi fi cations, leaving the ruling of the fourth Court of Justice standing and legalizing same-sex marriage in Virginia.

2017 elections

Herring did not face opposition in the Democratic primary and won his party's support for re-election. He defeated Republican opponent John Donley Adams and won re-election. Former opponent and partner, Justin Fairfax, won the race for Lieutenant Governor of Virginia in the same year.
