Robert Barnwell Clarkson (June 4, 1947 - March 1, 2010) is an American tax protector in South Carolina.

Clarkson graduated in 1969 from Clemson University with a bachelor's degree in economics. He served as platoon leader in the Vietnam War. Clarkson graduated from South Carolina Law School in 1974.

Lawyer misconduct

Clarkson grew up on charges of lawlessness in 1976 and in 1977 was charged on various accounts preparing for false tax filings and presenting false claims to the US Treasury. In 1978, his attorney's error checking was concluded in the South Carolina Supreme Court and he was dismissed.

According to the Southern Poverty Law Center, Clarkson has two federal tax-related criminal convictions. He was given probation with five years probation, under the condition that he was not involved with the income tax scheme.

Parole violations

The following year, Clarkson broke his probation and was sent to a federal prison. In 1984, he was re-released on condition that he was not involved with the income tax scheme. He violated his parole the following year and was once again sent back to the federal prison.

According to the Southern Poverty Law Center, Clarkson was involved with anti-government groups, and "sometimes dressed as 'The Great One, a masked hero representing resistance to the tax authorities.' In 1989, Clarkson started an organization called Carolina Patriots with two colleagues. They teach classes on how to avoid the demands of the Internal Revenue Service (IRS). Many clients have legal issues after receiving their suggestions.

1994 indictment and conviction

Beginning in 1994, federal agents attended classes and, in April, Clarkson and two colleagues were charged with conspiracy to impede, damage, obstruct and defeat the function of the Internal Revenue Service under 18 USCÃ, 371. All three were punished and convictions were imposed on appeal. They were sentenced to 57 months in prison. Clarkson was released from prison in April 1999.

In affirming Clarkson's and other defendants' beliefs, the US Court of Appeals for the Fourth Circuit rejected his argument that he had the First Amendment right in connection with the tax-related speeches held at meetings:

The words and actions of the accused are not far from the criminal act. The evidence shows that the defendants held meetings and raised money from participants they instructed and advised to claim unlawful exceptions and did not file income tax refunds or pay taxes on wages in violation of the United States Tax Code. The evidence shows that the participants followed the instructions and suggestions of the defendants, that the invalid actions of the participants were requested by the defendants, and that the defendants were aware that the participants followed their instructions and suggestions. The evidence reveals that the purpose of the meeting is to encourage people to commit unlawful acts by convincing them that it is legal to claim false exceptions, to hide income, and refuse to file income tax returns or pay income taxes [...] concluded that no reasonable juror could conclude that the words and actions of the accused only advocated opposition to the income tax law.

After being released from prison, Clarkson established an organization called the Patriot Network. He holds taxpayer meetings and sells books that claim to teach individuals how to avoid paying taxes.

2004 punish

In May 2004, the South Carolina Supreme Court ruled that Clarkson had been involved in unlawful legal practice and claimed that Clarkson was guilty of criminal defamation. He was sentenced to six months in prison. However, the sentence was suspended for five years, with three conditions: first, that Clarkson and the Disciplinary Advisory Office of South Carolina submit to an agreed disqualification tribunal stating that Clarkson is not a lawyer and has no license to practice law in South Carolina or in the state other; secondly, that Clarkson submits a written statement stating that such disclaimer is clearly and permanently placed on one and all of its websites and on all letters created and/or published by Clarkson; and third, that Clarkson is no longer involved in unlawful legal practice.

In 2005, the US Department of Justice (DOJ) filed a lawsuit requesting an order against Clarkson in the US District Court in South Carolina, requesting that the court prohibit Clarkson from selling tax schemes and holding classes. The department also asked the court to ask Clarkson to submit his client's name and address. The requested permanent order was issued in July 2007. According to a news release by the US Justice Department on July 3, 2007, the court "found that Clarkson wrongly instructed members of the Patriot Network that they did not need to file a federal income tax refund." The court also stated that Clarkson is assisting its members blocking the IRS's efforts to levy taxes. "Clarkson was also ordered" to give copies of orders to people who purchased their products and posted an order on the Patriot Network Web site. "

On September 16, 2008, Clarkson and his wife were arrested in their home town of Anderson, South Carolina and each accused of domestic violence. In a court hearing on September 17, Clarkson pleaded not guilty and accused his wife of being a drug addict that he said had been given to him. Clarkson stated that he gave his wife cocaine for "chronic fatigue." A few days later, Clarkson was arrested again and accused of violating injunction orders, unauthorized use of "911" emergency phone service, and first-degree harassment.
